Borderlesspay Mobile App

These Terms and Conditions (“Terms”) govern your access to and use of the Borderlesspay Mobile App (the “App”), operated by Borderlesspay Solutions Limited (“Borderless”, “we”, “our”, or “us”). The App provides wallet services, prepaid card issuance, and local spend in naira primarily for diaspora customers visiting or transacting in Nigeria.

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Definitions

  • App: The Borderlesspay Mobile App.
  • Borderless / We / Us: Borderlesspay Solutions Limited.
  • User / You: Any individual who uses the App.
  • Wallet: Digital accounts provided on the App
  • Prepaid Card: A physical card issued to you and linked to your Naira wallet.
  • FX Conversion: Conversion of foreign currency balances to Naira at applicable exchange rates.

2. Eligibility

To use the App, you must:

  • Be at least 18 years old;
  • Have legal capacity to enter into a binding contract;
  • Provide accurate, current, and complete information;
  • Not be subject to sanctions, restrictions, or prohibitions under applicable laws.

We reserve the right to refuse service or suspend accounts that do not meet eligibility requirements.

3. Account Registration and KYC

You must create an account to use the App. During registration, you agree to:

  • Complete identity verification (KYC) including submission of a valid international passport, selfie verification, and other required details;
  • Provide truthful and accurate information;
  • Maintain the confidentiality of your login credentials.

You are responsible for all activities carried out under your account.

4. Wallet Services

4.1 Foreign Currency Wallets

The App allows you to hold supported foreign currencies, including USD and GBP, which may be funded using eligible payment cards or approved channels.

4.2 Naira Wallet

Funds in your foreign currency wallet may be converted to Nigerian Naira (NGN) and credited to your Naira wallet. The Naira wallet is linked to your prepaid card for local spending in Nigeria.

5. FX Conversion

  • FX conversions are processed at rates displayed in the App at the time of transaction.
  • Rates may include applicable spreads or fees.
  • FX rates are subject to market fluctuations and regulatory requirements.
  • Completed FX conversions are irreversible.

6. Prepaid Card Issuance and Use

  • You will be issued a physical prepaid card at Borderlesspay’s discretion.
  • The prepaid card can be used for POS, ATM withdrawals, and online transactions where accepted.
  • Card usage is subject to transaction limits, daily limits, and network rules.
  • Lost or stolen cards must be reported immediately via the App or customer support.

7. Fees and Charges

Fees applicable to the use of the App may include:

  • Card issuance or replacement fees;
  • FX conversion fees or spreads;
  • ATM withdrawal or transaction fees;
  • Inactivity or maintenance fees (where applicable).

All fees are disclosed within the App prior to transaction confirmation.

8. Prohibited Activities

You agree not to:

  • Use the App for illegal or fraudulent purposes;
  • Engage in money laundering, terrorism financing, or sanctions evasion;
  • Provide false or misleading information;
  • Attempt to interfere with or compromise App security.

Borderlesspay reserves the right to investigate and report suspicious activities.

9. Suspensions, Restrictions, and Termination

We may suspend, restrict, or terminate your account without prior notice if:

  • Required by law or regulation;
  • You breach these Terms;
  • Suspicious, fraudulent, or unlawful activity is detected.

Remaining wallet balances, where permitted by law, will be handled in line with regulatory requirements.

10. Third-Party Services

Certain services (e.g., card networks, payment processors, identity verification providers) are provided by third parties. Borderlesspay is not responsible for the availability or performance of third-party services but will take reasonable steps to ensure continuity.

11. Intellectual Property

All content, trademarks, logos, and intellectual property on the App belong to Borderlesspay Solutions Limited or its licensors. You may not copy, modify, distribute, or exploit any content without prior written consent.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Borderlesspay shall not be liable for indirect, incidental, or consequential losses;
  • We are not responsible for losses due to market FX movements, card network failures, or force majeure events;
  • Our total liability shall not exceed the amount held in your wallet at the time of the claim.

13. Indemnity

You agree to indemnify and hold Borderless harmless from any claims, damages, losses, or expenses arising from your misuse of the App or breach of these Terms.

14. Data Protection and Privacy

Your personal data is processed in accordance with our Privacy Policy, which forms part of these Terms. By using the App, you consent to such processing.

15. Changes to These Terms

We may update these Terms from time to time. Updated versions will be communicated through the App. Continued use of the App constitutes acceptance of the revised Terms.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of Nigerian courts.
